Follow Nigerian Instagram influencer and alleged cyber-criminal, Raymond Abass popularly referred to as hushpuppi along with his accomplice Olalekan Ponle also known as Woodbery have been extradited to the United States and handed over to the Federal Bureau of Investigation (FBI) for further prosecution. It had been speculated by observers that the United States wanted to Hushpuppi to be extradited because majority of the scammed victims were American citizens. The Federal Bureau Investigation also has more resources to prosecute the state so they lobbied the Dubai Police Force to transfer Hushpuppi and his accomplice. The fraud was worth more than Dh1.6 billion in total which translates to approximately ₦170,000,000,000 (One Hundred and Seventy Billion Naira) from nearly 2 million victims, mostly Americans. The Dubai police force intimated that they seized more than Dh150 million in cash from them and confiscated 13 luxury cars worth Dh25 million as well as confiscating 21 computers, 47 smartphones, 15 memory cards, five hard disks containing 119,580 fraud files. If prosecuted and found guilty, people wonder what will happen to all the money and assets he allegedly defrauded from his victims. There are two possibilities that will happen to the stolen monies; Order of Restitution If the perpetrators of an online scam (Hushpuppi, Woodberry and other accomplices) are convicted, they may likely be ordered to pay restitution to their victims. Restitution is a payment that is meant to financially restore victims of a crime to the point they were at prior to the commission of the crime. Hushpuppi will not be the first Nigerian scammer to be ordered to restitute his former victim, sometime ago a Nigerian fraudster, Onyekachi Emmanuel Opara was sentenced to five years imprisonment in a New York for attempting to defraud victims of more than $25 million through internet scams. Aside his prison term the New York court also ordered him to pay $2.5 million (Two Million Five Hundred Thousand Dollars) as restitution for his victims. For victims to get restituted however they have to follow certain steps, as a federal crime victim (like Hushpuppi’s victims) you should contact the U.S. Attorney’s Office who will direct you to the proper office to help you recover your lost assets. Order of Compensation In event when the court does not order restitution it can also decide that an offender should pay the victim(s) compensation. The court grants compensation in two major scenarios. First the Courts order compensation when the convicted criminal cannot afford to restitute all the money he stole from his victims. The amount to be compensated will be limited to what they can afford and may depend on the sentence the court has given them. Secondly Courts order compensation when they are sentenced for a short period or if they are not being sent to prison. The courts will expect the convict to get sources of income where he can get the compensation sum to pay to the courts and the courts will pay the victims their compensation fee. Compensation fees do not cover the full cost of your damage or loss and most times the convict will have to pay it in installments. It is the court’s duty to make sure that the offender pays the compensation and the victims only interact with the court and not the convict. Conclusion The enormity of the fraud allegedly committed by Hushpuppi will most likely get an order of restitution like Opara, especially since he is likely to go to prison for a while. The FBI will prosecute Hushpuppi under Federal Law and is facing a possible sentence of over twenty years.
